Allergan Settles Kickback Lawsuit for $13 Million

Years of legal wrangling came to a close with Allergan agreeing to a $13 million settlement for claims the company illegally promoted eye drugs by providing consulting and other services to doctors.

Filed in 2009 under federal whistleblower protections, the lawsuit alleged that Allergan representatives targeted doctors around the country and pushed Restasis and other drugs for off-label uses.

In exchange for prescribing the company’s drugs, doctors would be enrolled in “Allergan Access,” a membership program and website providing financial analysis, human resource tools, continuing education resources and other services. The company also offered payments for doctors who attended product-specific promotional meetings and dinners, according to the lawsuit.
