J&J, Boston Scientific to Battle Again Over Same Stent Patent

Years after a jury found Boston Scientific infringed on a Cordis stent patent, the Johnson & Johnson (J&J) unit has filed a new lawsuit over the same patent, alleging that Boston Scientific’s new stent is no different. The suit, filed in the U.S. District Court for the District of Delaware, comes right after Boston Scientific received FDA approval to market its second-generation Taxus Liberte paclitaxel-eluting coronary stent in the U.S. earlier this month. Cordis claims the Taxus Liberte, which has no “colorable difference” from the first-generation model, infringes on the company’s Gray patent, which relates to stent architecture and geometry.
