Stryker Wins Suit, Continues to Battle Class Action

A class action suit against Stryker over a squeaky hip implant continues after a Colorado judge ruled in favor of preemption in a separate suit over the same device late last month. In the Colorado case filed by Jama Parker, the state court turned to the Supreme Court’s ruling in Reigel v. Medtronic and decided in favor of Stryker, concluding that Parker’s claims are preempted because the Trident Ceramic Acetabular System has FDA premarket approval. Parker also filed a product liability class action lawsuit against the company in the U.S. District Court for the District of New Jersey for the same device.
