N.H. Supreme Court Okays Attorney General’s Use of Private Law Firm to Investigate Drugmakers

New Hampshire’s Supreme Court ruled private attorneys can continue to represent the state in an investigation into the pharmaceutical industry.

The court made the ruling in response to a challenge by Actavis Pharma, Endo Pharmaceuticals, Janssen Pharmaceuticals, Purdue Pharma and Teva Pharmaceuticals.

The New Hampshire Attorney General’s Office retained the private law firm Cohen Milstein in June 2015 to represent it in its investigation of allegations that the drugmakers fraudulently marketed opioid products. They subsequently revised the agreement to specify that the law firm would “assist” the state.
