MORENA VISTA SUES HONG KONG FIRM FOR MISREPRESENTATION

Morena Vista Trading has filed suit against Kinetana International BioTech Pharma in the California State Superior Court seeking damages of $6 million for intentional misrepresentation, breach of contract, civil racketeering and corrupt organization claims. Kinetana is a pharmaceutical company publicly traded on the Growth Enterprise Exchange of the Hong Kong Stock Exchange with principal places of business in Edmonton, AB Canada and Hong Kong.

The suit also names Kinetana Holdings/ Kinetana Group, of Canada, its subsidiaries and key board members and shareholders, Yun Tam, Nuzhat Tam-Zaman and Sui Leung Yeung. The litigation seeks damages and relief of $6 million for alleged instances of intentional misrepresentation, breach of contract, civil racketeering and corrupt organization claims. Morena Vista Trading is requesting a jury trial and that a constructive trust be imposed over the joint venture. The date of the trial is pending.

Morena Vista Trading (dba Kairos-Meade), a California-based strategic business development and marketing company, formed a joint venture with Kinetana in April 2004 to establish sales of Kinetana products in the U.S. and Canada.

Editor's Note: The lawsuit was dismissed in May 2006 with prejudice on mutually agreeable terms. Neither party admitted fault and Darren Meade retracted prior statements about Yun Kau Tam, Nuzhat Tam-Zaman and all Kinetana subsidiaries, according to a press release jointly issued by the parties.
