A federal appeals court has upheld a ruling that AstraZeneca didn’t intentionally mislead the PTO to gain a patent on its blockbuster antipsychotic Seroquel. The U.S. Court of Appeals for the Federal Circuit determined that Teva Pharmaceuticals USA and Sandoz, during litigation over the ’288 patent covering Seroquel (quetiapine fumarate), didn’t provide enough evidence to establish that AstraZeneca withheld relevant test data from the PTO.
