Sepracor Finds Potential $100 Million Mistake in Medicaid Pricing
Sepracor disclosed it may have to reimburse the federal Medicaid rebate program and other federal and state programs between $80 million to $100 million for Medicaid pricing mistakes made between 2002–2007. The company added that figure may end up being higher, and it may be subject to additional penalties.
The company said it is reviewing its government price reporting and notified the Centers for Medicare & Medicaid Services Jan. 17 that it had identified “potential errors in its Medicaid Best Price.”
Sepracor cited two possible mistakes. The first was excluding transactions involving the Pennsylvania General Assistance Program from calculations for products reimbursed under the Medicaid Drug Rebate Program. The second was extending a price reserved for qualified Public Health Service-covered entities to customers who were not qualified to receive it.
