In the anti-kickback and fraud abuse provisions, the way a company promotes can have bearing and effect on other laws, such as the False Claims Act (31 U.S.C. 3729), which prohibits knowingly making or using (or causing to be made or used) “a false record or statement to get a false or fraudulent claim paid or approved by the Government.”
