Merck Takes Sandoz to Court Over Emend ANDA
Merck is suing Sandoz for infringing on four patents covering Emend, a drug used in combination with other anti-emetic agents to prevent acute and delayed nausea and vomiting associated with certain types of chemotherapy. Sandoz informed Merck in January that it had filed an ANDA for generic Emend (aprepitant) with Paragraph IV certifications on the ’147, ’859, ’742 and ’735 patents.
