Appeals Court Remands Fresenius Patent Case
A federal appeals court has remanded a dispute between Baxter International and Fresenius Medical Care Holdings involving patents covering the System 1000 hemodialysis machine. The dispute involves the sale of Fresenius’ 2008K hemodialysis machine that Baxter maintained infringed its patents. The U.S. District Court for the Northern District of California ruled against Fresenius, and a jury awarded Baxter about $14.3 million in damages, despite a previous jury finding that certain patent claims were invalid.
