Pay-for-Delay Healthcare Measure Proposed by Sen. Kohl
Sen. Herb Kohl (D-Wis.) introduced an amendment
to healthcare overhaul legislation being considered in the Senate that would eliminate pay-for-delay settlements between brand- and generic-drug makers.
The amendment incorporates the Preserve Access to Affordable Generics Act, S.
369, sponsored by Kohl earlier this year. Kohl’s measure retains the presumption that pay-for-delay deals — in which brand companies reward
generic-drug makers to delay introducing less expensive medicines — are illegal.
