Synthes Loses Patent Appeal Over Spinal Kinetics Devices
The U.S. Court of Appeals for the Federal Circuit has affirmed a lower court decision that found Synthes’ ’270 spinal implant patent invalid for lack of written description. Synthes alleged that Spinal Kinetics’ M6-C and M6-L intervertebral implants infringed on the patent, which covers prosthetic devices designed to replace a diseased or degenerated disc between adjacent vertebrae. The Spinal Kinetics devices at issue are sold outside the U.S.
