Judge Rules Apotex, Amneal Infringed on Livalo Patents
Japanese drugmaker Kowa prevailed in its patent infringement suit against Apotex and Amneal.
U.S. District Judge Paul Crotty of the Southern District of New York ruled Kowa’s patent on the cholesterol statin Livalo was valid and that Apotex infringed upon it. Amneal had already conceded the patent infringement.
In a Sept. 19 ruling, Crotty wrote that the plaintiffs met the preponderance of evidence standard to demonstrate Apotex infringed on Kowa’s patent in an ANDA it submitted.
