CMS Finalizes Update to Medicaid Rebate Agreement

The Centers for Medicare & Medicaid Services finalized its new Medicaid and Medicare Part B national drug rebate agreement.
Under the agreement, drugmakers must pay quarterly rebates to state Medicaid programs based on units of the drug dispensed to Medicaid beneficiaries. The revision brings the 1991 rebate agreement into alignment with the Affordable Care Act and incorporates other CMS policy changes over the years.
Drugmakers with existing agreements have until Oct. 1 to sign the revised agreements.
