Shire Prevails in Adderall Patent Lawsuit
A U.S. district court awarded Shire Pharmaceuticals a victory last week, ruling that a rival’s application for a generic of Adderall XR violated the company’s patents.
In his ruling, Judge William S. Young of the District of Massachusetts wrote that an ANDA formulation by Abhai, a small Pennsylvania-based drugmaker, infringed on two Shire patents.
In his decision, Young blasted Abhai for misconduct during the litigation process. Last April, he wrote, the company revealed that it had produced incorrect stability dissolution testing data.
