A district court has upheld a jury verdict in favor of Boston Scientific in a patent infringement case against Cordis, a Johnson & Johnson (J&J) company. Cordis says it will appeal the ruling.

The U.S. District Court in Delaware upheld a July 2005 jury verdict that J&J's Cypher drug-eluting stent infringed on a Boston Scientific patent, Boston Scientific said June 15.

Citing prior rulings by U.S. Court Judge Sue Robinson in favor of Cordis, that company said it will appeal the decision to the Court of Appeals for the Federal Circuit in Washington, D.C.
