Pregnancy Testmaker Agrees to FTC Consent Order

Inverness Medical Innovations has agreed to settle FTC charges that it illegally maintained its U.S. monopoly of consumer pregnancy tests and stifled future competition from two emerging alternative technologies. The charges stem from Inverness’ 2006 acquisition of assets from Acon Laboratories, including a digital pregnancy test that was part of a joint venture Acon had with Church & Dwight, Inverness’ leading competitor. The consent order requires Inverness to disclaim any ownership rights for intellectual property developed during Acon’s joint venture with Church & Dwight.
