Warner Chilcott Unit, Mayne Sue Over Generic Doryx

A Warner Chilcott subsidiary and Mayne Pharma have sued Impax Laboratories, Mutual Pharmaceutical and Mylan Pharmaceuticals for submitting ANDAs to market a generic version of the antibiotic Doryx before patent protection expires. In the case filed late last month, the plaintiffs allege the defendants have infringed on the ’161 patent covering Doryx (doxycycline hyclate). The plaintiffs have asked the court to delay the approval of the ANDAs until after the patent expires in December 2022.
