To avoid conflict down the road, research sites must insist on clarity in the contracts they draft with sponsors and contract research organizations, LaDale George, an attorney with Neal, Gerber & Eisenberg, said. Key clinical trial contract provisions include compensation, termination, indemnification, subject injury, regulatory compliance, intellectual property, the scope of work, publicity for the trial, publication of results, the term of the agreement and exclusion of investigators who are debarred by the FDA or are suspended from receiving Medicare or Medicaid funds.
