As the number of lawsuits against devicemakers for off-label promotion of products continues to increase, companies should ensure their marketing and promotional materials do not end up as evidence for government investigations. In recent years, the government has shifted its focus from the pharmaceutical to the medical device industry, according to Peter Spivack of law firm Hogan & Hartson.
