Appeals Court Upholds Solvay Dismissal in False Claims Case

Solvay Pharmaceuticals won a federal appeals court ruling upholding its dismissal from a whistle-blower lawsuit over the marketing of its Marinol treatment for chemotherapy-induced nausea, vomiting and loss of appetite in HIV patients. The U.S. Court of Appeals for the 11th Circuit upheld the ruling from the U.S. District Court for the Middle District of Florida, which found that there was no proof the company was responsible for causing the government to pay false claims through Medicaid and other government programs for the drug, according to an opinion posted on the appellate court’s website Monday.
