Court: Liability Is Possible for Generic Reglan Makers

A federal appeals court has reinstated generic-drug makers as defendants in a preemption-related case about liability and labeling of the drug Reglan, reversing a lower court ruling. “The regulatory framework makes clear that a generic manufacturer must take steps to warn its customers when it learns it may be marketing an unsafe drug,” according to the U.S. Court of Appeals for the Eighth Circuit.
