Justice Sues J&J Over Alleged Kickbacks to Omnicare
January 18, 2010
The Justice Department has filed a whistle-blower complaint against Johnson & Johnson (J&J), accusing the drugmaker of engaging in kickback schemes with Omnicare, a geriatric pharmacy services provider, to boost sales of J&J drugs. The complaint, filed Friday in the U.S. District Court for the District of Massachusetts, accuses J&J of violating the False Claims Act by paying Omnicare tens of millions of dollars between 1999 and 2004 to induce the company to purchase and recommend the antipsychotic Risperdal (risperidone) and other J&J drugs.
