Court Rules for Sun in Lawsuit Involving Generic Protonix

A federal court has dismissed a Wyeth lawsuit against Sun Pharmaceutical Industries that accused the company of falsely advertising its generic version of Protonix. Wyeth based its accusation on the active ingredient in Sun’s drug, which contained a different polymorph of the chemical compound used in Wyeth’s drug. Sun argued that the drug’s labeling was not falsely marketing the product because the polymorph information was on the package insert and the labeling was approved by the FDA.
