Watson False Marking Suit Is Latest in Worrying Trend for Drugmakers

A new cottage industry of suing drugmakers for labeling their products with expired patents has emerged seemingly overnight and has the potential to inflict significant financial damage. Watson Pharmaceuticals became the latest involved in such litigation this week when the group Promote Innovation sued the company in the U.S. District Court for the Eastern District of Texas for marking an expired patent on its skin patch Androderm (testosterone).
