Drugmakers’ False Claims Settlements Bring in Billions for Justice

The scope of the Justice Department’s stepped-up enforcement campaign against off-label marketing and other violations of the False Claims Act is coming into focus, with the agency saying it has recovered nearly $5 billion in taxpayer funds from the healthcare industry since January 2009. In addition to the recovered funds, Justice also collected more than $3 billion in fines from the healthcare industry and secured 25 criminal convictions in that time period, Assistant Attorney General Tony West said. The drug and device industries accounted for about $1.6 billion of the taxpayer funds, as well as significant fines.
