Major Drugmakers Wary of Release of Pay-for-Delay Settlement Details

Dozens of the world’s biggest drugmakers have lined up in opposition to a proposed court order that could expose details of their patent-settlement agreements. In a case involving its alleged deal with Watson over the excessive-sleepiness drug Provigil (modafinil) — now proceeding in the U.S. District Court for the Eastern District of Pennsylvania — Cephalon wants details on all the pay-for-delay settlements the FTC has reviewed so it can prepare its defense. Pfizer, Merck and Johnson & Johnson joined other drugmakers in a motion to intervene demanding that Cephalon’s request be refused.
