Kohl Again Pushes for Legislation Banning Pay-for-Delay Deals

February 1, 2011
Sen. Herb Kohl (D-Wis.) is once again renewing his fight against pay-for-delay deals by reintroducing legislation that would ban the agreements. Despite seeing his measure added, and then dropped, from several different bills last year, Kohl, along with Sen. Chuck Grassley (R-Iowa), reintroduced the Preserve Access to Affordable Generics Act on Wednesday. The legislation would amend the FTC Act, banning any agreements between brand and generic companies in which an ANDA filer receives anything of value or agrees to limit or forgo research, development, manufacturing or sales of its generic drug for any period of time.
