Oregon Sues J&J Over ‘Phantom’ Motrin Recall

Oregon is suing Johnson & Johnson (J&J) over its controversial “phantom recall” of defective Motrin, alleging the drugmaker failed to appropriately notify retailers and consumers of possibly defective product.

The lawsuit alleges the company and two subsidiaries — McNeil-PPC and McNeil Healthcare — exposed consumers to defective Motrin by putting off public disclosure of the problem for more than a year before a 2010 public recall.

Instead, J&J allegedly attempted to “quietly remove Motrin containers from store shelves” and did not notify consumers who had already purchased the product, the Oregon Department of Justice (DOJ) said last month. It notes about 787 eight-count containers of Motrin sold by Oregon retailers are unaccounted for.
