OIG Clarifies Media Misconceptions Over Possible Exclusion for Forest CEO

Citing inaccuracies in media reports on the potential exclusion of Forest Laboratories’ CEO Howard Solomon from federal healthcare programs, the HHS Office of the Inspector General (OIG) has issued a fact sheet covering its exclusion practices and how they affect Forest. The OIG is authorized, under section 1128(b)(15) of the Social Security Act, to exclude any officer or managing employee of a company convicted of certain criminal offenses. In the fact sheet, released May 10, OIG says it will consider certain factors in its decisions to exclude an officer or managing employee due to criminal offenses.
