Sunshine Act Compliance Delayed to 2013 Under CMS Proposed Rule

Devicemakers no longer need to meet a Jan. 1 Sunshine Act deadline for reporting payments to doctors and hospitals. Manufacturers of drugs, biologics, devices and medical supplies covered by Medicare, Medicaid or the Children’s Health Insurance Program can now wait until final regulations are issued before collecting data on their payments, a Centers for Medicare & Medicaid Services (CMS) proposed rule states. The rule asks for feedback on the amount of time manufacturers will need to begin collecting data after a final rule is published. Comments are due Feb. 17, 2012.
