Bayer Sues Warner Chilcott Over Patent Infringement

Bayer Pharma AG has filed a lawsuit against Warner Chilcott in the U.S. District Court of Delaware, alleging that Warner’s oral contraceptive Lo Loestrin FE infringes on a Bayer patent. In its filing, Bayer claims Warner infringed on its ’940 patent for the combination of two hormone components, and the U.S. Patent and Trademark Office did not consider this patent when Warner’s ’984 patent was issued for Lo Loestrin in 2010.
