Ohio Citizen Drug Price Initiative Goes Federal

The fight for lower drug prices has moved to the federal level, with citizens filing suit against Ohio Secretary of State Jon Husted for failing to advance a citizen ballot initiative to the General Assembly.

Filed in the U.S. District Court for the Southern District of Ohio, the suit alleges Husted violated the plaintiffs’ First Amendment rights to speech and to petition the government by sending the Ohio Drug Price Relief Act back to the Board of Elections for a “re-review.” The Ohio Drug Price Relief Act would require state programs to pay the same amount or less for prescription medications as the U.S. Department of Veterans Affairs.
