Federal Judge Signs Off on Injunction Against Dietary Supplement Maker

A federal judge has ordered Florida dietary supplement distributor Viruxo to stop selling a product that it claimed could treat herpes.

Judge James S. Moody, Jr. of the U.S. District Court for the Middle District of Florida entered a consent decree of permanent injunction between the U.S. Department of Justice and the distributor, James Hill, for illegally distributing an unapproved new drug and misbranded drug.

If Hill intends to start marketing or selling the product or the “processing, packing, repacking, labeling, holding or distributing … any article of drug,” Hill must notify the FDA at least 90 days beforehand.
