Express Scripts Fires Back at $15B Anthem Lawsuit

Pharmacy benefit manager Express Scripts is firing back at Anthem’s $15 billion lawsuit that accuses the PBM of breaching good faith negotiation requirements.

Anthem initially filed a lawsuit against Express Scripts in March, alleging the PBM overcharged the insurance company and is refusing to renegotiate future drug prices. The PBM repeatedly violated a 10-year agreement between the companies, Anthem says.

Express Scripts contends that it “has no obligation…to ensure that Anthem is receiving competitive benchmark pricing,” and that its sole responsibility is to “negotiate in good faith” over proposed new pricing terms.
