FDA Finds Culpabilities for Viva Nutraceuticals for Drug-like Supplement Claims

August 16, 2016

Viva Nutraceuticals has received an FDA warning letter for making a litany of drug-like claims on its website and at a recent trade show.

The letter complains that the company used promotional language reserved for prescription drugs to promote seven products, in violation of federal law.

FDA reviewers said that five products sold on its website — Eyestonia, Golden Omega-3 Max, Indole-3-Carbinol 200 mg, L-Lysine 1000 mg and Pros Tac Softgel — were promoted using such claims, which ranged from lowering cholesterol levels to treating depression.

The letter notes that none of these products are recognized as safe and effective for the uses being promoted, thereby rendering them unapproved new drugs.
