Nestle and Galderma Sue Perrigo Over Patents for Rosacea Therapy

Nestle Skin Health and Galderma Laboratories have filed a patent lawsuit against Perrigo and Perrigo UK over patents related to the topical gel Mirvaso, which clears up facial redness.

Perrigo has filed an ANDA to get FDA approval for its product, which contains the same active ingredient as Mirvaso. If approved, the Perrigo product would be allowed to sell before Nestle’s six patents expire. The lawsuit was filed in the U.S. District Court for Delaware.

Nestle and Galderma received written notification of Perrigo’s ANDA in June, including an accompanying Offer of Confidential Access to certain Perrigo confidential information regarding the Perrigo ANDA product.

Nestle and Galderma are asking for monetary relief to the extent Perrigo commercially manufactures, uses, offers for sale, or sells within the United States, or imports into the United States, any product that infringes or induces or contributes to the infringement of their patents in addition to Perrigo’s ANDA being denied.
