DOJ Subpoenas Taro Pharmaceuticals in Response to Generics Prices

September 19, 2016

The U.S. Department of Justice issued grand jury subpoenas to Taro Pharmaceuticals and two of the company’s senior officials over the pricing of its generics, the drugmaker revealed in an SEC filing.

The DOJ’s antitrust division is requesting corporate and employee records related to the company’s generic products and pricing. These documents include any communication with competitors on the sale of generics, the SEC filing stated.

The company’s disclosure does not name the company officials subpoenaed or specify which products the probe will examine. In recent months, however, attention has been drawn to the rise in the company’s price for clobestal, which is a topical ointment. Between 2011 and 2014, the price of 15 grams of the ointment, for instance, soared to $133 from $9.07.
