CMS Proposes Updates to Medicaid Drug Rebate Agreement

The federal government is proposing to update Medicaid’s National Drug Rebate Agreement to reflect legislative and regulatory changes that have taken place since it was issued in 1991.

The Medicaid Drug Rebate Program (MDRP) involves three entities: state Medicaid agencies, CMS, and more than 600 participating drug manufacturers. All participating manufacturers, which include those new to the program, will have to sign the newly revised NDRA once it’s finalized. Industry sources say these are the first proposed changes to the agreement in its 25-year history. In addition to bringing the agreement in line with outpatient drug regulation, the agency is also updating the NDRA to make technical, editorial and structural changes.

The Centers for Medicare and Medicaid Services issued the proposed changes to the NDRA in the Federal Register. Comments on the proposed rule are due Feb. 7, 2017.
