Missouri Court Denies All 9 Medtronic Summary Requests, Infuse Litigation Continues

A Missouri judge has denied Medtronic’s appeal against a jury trial, dismissal, and transferring of trial in the case accusing the company of falsely marketing its Infuse bone graft LT-cage lumbar tapered fusion device system.

Medtronic argued that it had no part in the design and marketing of the Infuse device. Judge Neill disagreed, noting that Medtronic was “intimately involved in the design, manufacture and marketing of Infuse medical devices.”

Despite Medtronic’s arguments, the case is moved to trial in the St. Louis in February, 2017. — Cynthia Jessup
