Just in Time for the Holidays: FDA Publishes Guidance on Accepting Gifts

The FDA laid out its principles and policies for accepting gifts from the public, including a list of immediate disqualifiers.

The agency’s final guidance applies to all resources of monetary value given to FDA as an institution, including competitive grants awarded to agency employees, as well as any materials, data, information or services.

The policy does not cover gifts from the Reagan-Udall Foundation, a private nonprofit created by Congress to support the FDA’s regulatory science projects — nor does it cover samples taken during site inspections, resources provided under Cooperative Research and Development Agreements, or gifts to individual employees. The guidance finalizes a draft published this summer.
