Right-to-Try Legislation Finds Support on Capitol Hill and in the White House

Two congressmen introduced right-to-try legislation in the House this week, which could find broad support from Congress and the White House.

The law would allow terminally ill patients to use unapproved products that clear Phase I safety testing — while barring the FDA from considering outcome data stemming from compassionate use in subsequent product reviews, and insulating companies from liability.

The Right to Try Act of 2017, introduced by Reps. Andy Biggs (R-Ariz.) and Brian Fitzpatrick (R-Penn.), is an identical companion to a bill being pushed in the Senate by Sen. Ron Johnson (R-Wis.), the Trickett Wendler Right to Try Act, which stalled in the previous Congress last fall.
