Court Rules Par Generic Infringes on Ferring’s Prepopik Patent

A Delaware federal court ruled that Par’s generic of Ferring’s Prepopik colonoscopy preparation treatment infringed on the company’s patent.

The case turned on Ferring’s claim to a manufacturing process to produce the medication in granules with a “spray-coated layer of sodium picosulfate coating a potassium bicarbonate core.”

Judge Richard Andrews found Ferring’s expert testimony more convincing than Par’s, saying their explanation was more persuasive and their expertise more closely aligned with the technology being disputed in the manufacturing process.
