Judge Throws Out Claims of Anticompetitive Behavior Against Suboxone Maker

A federal judge dismissed more than 40 states’ claims against the parent company that manufactures Suboxone in a suit accusing it of suppressing generics.

In an Oct. 25 decision, Judge Mitchell Goldberg of the Eastern District of Pennsylvania threw out the civil claims against Indivior, one of several companies accused of delaying generic opioid addiction treatments using anticompetitive behavior to protect its branded products.

Invidior, the defendants claimed, cannot be held liable as it did not exist until 2014, whereas the anticompetitive behavior at issue was stated to have occurred between 2007 and 2013.

The plaintiffs, meanwhile, argued the company has continued to reap the benefits of the earlier anticompetitive conduct and that it functioned as the successor to Reckitt Benckiser Group, which restructured in 2014.
