Ex-Pharmakon Compliance Director Pleads Guilty to Conspiracy to Defraud

A former employee of an Indiana compounding pharmacy pleaded guilty to adulterating drugs that were eventually shipped across state lines.

The Justice Department said that Caprice Bearden, while director of compliance for Pharmakon Pharmaceuticals, committed one count of conspiracy to defraud the U.S., three misdemeanor counts of introducing adulterated drugs in interstate commerce and six misdemeanor counts of adulterating drugs while held for sale after shipment of a drug component.

Bearden’s plea agreement included an acknowledgment that she lied to the FDA during two separate inspections when she told officials Pharmakon had never received any out-of-specification drug potency test results.
