Judge Allows Suit Against Compounder for Overcharging TRICARE to Go Ahead

A Florida federal judge ruled Monday that the federal government’s False Claims Act complaint against a compounding pharmacy can proceed.

The lawsuit accuses Tampa, Florida-based RS Compounding of charging TRICARE at least 2,000 percent and in some cases 10,000 percent more for drugs than it charged customers who paid cash between January 2012 and January 2014.

The original lawsuit was filed in 2013 under the FCA’s whistleblower protections but the Justice Department announced it would join the suit this July.
