DOJ Recovered $900 Million From FCA Violators in Pharma Last Year

The Justice Department recovered more than $900 million from medical product manufacturers relating to False Claims Act violations in fiscal 2017, down from $1.2 billion in 2016.

The higher amount recovered in 2016 was due largely to a $784.6 million settlement with Wyeth and Pfizer over fraudulent price reports for two acid reflux drugs.

Major settlements in 2017 included Shire Pharmaceuticals’ payment of $350 million over accusations that it improperly incentivized doctors and clinics to use its products through monetary kickbacks and perks like dinners, drinks and entertainment. The Shire settlement also covered accusations of unlawful off-label promotion and false claims to inflate prices.
