DA Files First Suit Against Opioid Makers Under State Consumer Protection Law

The Philadelphia District Attorney is suing opioid manufacturers and is the first to sue under Pennsylvania’s consumer protection law — making it a public enforcement action on behalf of all Philadelphia residents.

District Attorney Larry Krasner accused the plaintiffs of downplaying their products’ potential for addiction and using false and deceptive practices in marketing their products to doctors, which Purdue last week announced it will end.

The suit filed in the Philadelphia Court of Common Pleas makes similar claims as the 16 other lawsuits filed by Pennsylvania counties against Purdue, Allergan, Cephalon, Teva, Endo, Janssen and Johnson & Johnson. But the Krasner suit includes a mechanism to direct any fines or damages directly to those the district attorney says were harmed.
