Federal Judge Tosses Dr. Reddy’s FCA Suit

A federal judge threw out a lawsuit alleging Dr. Reddy’s led to the federal government being billed for drugs in packaging untested for safety.

In his ruling, Judge C. Darnell Jones II of the Eastern District of Pennsylvania ruled the suit had no grounds under the False Claims Act because the whistleblowers did not allege any factual falsehoods.

Judicial precedent holds that companies or entities are only liable under the FCA if they were reimbursed specifically as a result of false representations, he said.
