Appeals Court Finds in Mylan’s Favor Over Patent for Gastrointestinal Drug

An appeals court affirmed a decision by a Florida judge that Mylan did not infringe upon a Shire patent for its gastrointestinal drug Lialda (mesalamine).

Judge Charlene Edwards Honeywell of the Middle District of Florida originally ruled in January 2017 that Mylan violated Shire’s patent with its proposed generic for Lialda. Last June, however, Honeywell vacated her ruling after the U.S. Court of Appeals for the Federal Circuit reversed the decision.

Following an appeal by Shire, the appeals court found Honeywell was within her rights to overturn her original ruling.
